LB 1105

Effective July 1, 2016 LB 1105 passed with the following changes:

  • Created a Nebraska Craft Brewery Board, with the following powers:
    • Establish a public forum to provide any manufacturer of beer or producer of agricultural products used in brewing process the opportunity, at lease once annually, to discuss with the board its policies and procedures;
    • Keep minutes
    • Approve expenditure of funds collected
    • Serve as an advisory panel to the Liquor Control Commission
    • Adopt and promulgate rules and regulations
  • Redefine Club
  • Remove citizenship requirement, replaced with perminent residence
  • Redefine manufacturer
  • Redefine hard cider
  • Create a new retail Class J license for "limited alcohol sales" for off sale
  • Removed the requirement for a new application when a location is annexed
  • Allow 16 year olds to complete a sale of alcohol transaction
  • Remove the language that allows a retailer to apply for a wholesale liquor dealer's license
  • Add a penalty for a person guilty of manufacturing spirits
