With the recent flooding and resulting post flood clean-up , the Nebraska Liquor Control Commission has received many inquires as to the status of alcoholic product that has come into contract with floodwaters.
After consulting with the Department of Agriculture' s Dairies and Food Division, the following protocol SHALL be followed. Any product container which has come into physical contact with floodwaters cannot be sold . They need to be destroyed by the retailer and any claim for loss shall be made against the retailer 's insurance carrier.
Wholesalers shall not pick up the product nor reimburse or otherwise credit the retailer account. Any such reimbursement or credit would be a violation of Neb. Rev. Stat. 53-168.
